By accessing and utilising this Site, you agree to be bound by the following Terms and Conditions, so please carefully read this section before proceeding. Palazzo Bifora reserves the right to change, modify, add or remove portions of these terms at any time and make changes to the products and programmes described in the Site at any time and without notice or liability. Subject to the provisions of the Data Protection Laws, with respect to all communications you make to OJALA LTD. regarding Palazzo Bifora information, including but not limited to feedback, questions, comments, suggestions and the like: (a) you shall have no right of confidentiality in your communications and OJALA LTD. shall have no obligation to protect your communications from disclosure; (b) OJALA LTD. shall be free to reproduce, use, disclose and distribute your communications to others without limitation; and (c) OJALA LTD. shall be free to use any ideas, concepts, know-how, content or techniques contained in your communications for any purpose whatsoever, including but not limited to the development, production and marketing of products and services that incorporate such information.

General

The Terms and Conditions of use apply to your use of the Site, including all transactions effected by you. If any provision of these Terms and Conditions or any part thereof is rendered void, illegal or unenforceable, it shall be void, illegal and unenforceable to that extent only and the remainder shall remain in full force and effect.

You agree that no joint venture, partnership, employment, or agency relationship exists between
you and OJALA LTD. as a result of this agreement or use of the Site. Any rights not expressly granted to you herein are expressly reserved by OJALA LTD.

Governing Law and Choice of Forum

These Terms and Conditions of Use and any disputes arising out of or related to the Site or use of the Site shall be governed exclusively by Maltese law and exclusively enforced in Maltese Courts. You expressly agree to the exclusive governance of Maltese law and submit to the exclusive jurisdiction of the Maltese courts.

Booking terms and conditions:

Your reservation and the accommodation agreement made with OJALA LTD.,
whether made directly through the Palazzo Bifora (hereinafter “Boutique Hotel”) website or via a third party, will be subject to these Booking Terms and Conditions.

Reservation

1. When a reservation made via this website (hereinafter the ‘Site’) or by telephone, it will be deemed that you have read, understood and accepted these Booking Terms and Conditions.
2. If you make your reservation through a travel agent or any other third party, then OJALA LTD. shall have no liability for any acts or omissions of such party.
3. All information regarding rooms, facilities and services offered at Palazzo Bifora contained on
the Site does not make any representation or warranty, express or implied, of any kind with respect thereto.  Such information may be inaccurate as a result that the Site has been launched prior to the opening of the Boutique Hotel.  The Site may also contain typographical errors or omissions.  OJALA LTD. shall not be liable for any discrepancy in the rooms, facilities or services available on the Site or for any other errors or omissions, and shall not be liable for any damages that may result therefrom.
4. The Parties to the contract are the Boutique hotel and the Customer. If a third party placed the order on behalf of the Customer, then that party shall be liable vis à vis the Boutique Hotel for all obligations arising from the Boutique hotel accommodation contract as joint and several
debtor together with the Customer, insofar as the hotel has a corresponding statement by the
third party.
5. Any complaints relating to hotel reservation should be submitted by email. Cancellations, Failure to make use of the Boutique Hotel Services due to no show
1. Free cancellation applies only if you cancel your stay up to 24 hours prior arrival and no later
than 12pm Boutique Hotel local time. Free cancellation requires the Boutique Hotel’s
written consent.
2. One-night charge will apply to late cancellations. The credit card provided at time of booking
will be charged for the one-night stay.
3. Full stay change will apply to failure to make use of the Boutique Hotel Services due to no
show.

4. Reservations with prepayment cannot be changed and/or cancelled in any way, and sums
paid in advance as a deposit cannot be refunded.
5. Guests departing before their booked checkout date will be charged for the remaining nights
of the original reservation confirmation.

Agreement on evidence

Entry of the necessary bank details and acceptance of these terms and conditions and the
reservation form constitutes the contractual obligation between the hotel and the Customer.

Hotel Prices

1. The prices indicated on the Site for the Palazzo Bifora rooms are subject to availability.
2. The Customer is obliged to pay the current or agreed Boutique Hotel prices for the hire of the room and for any other services he has made use of. This also applies to services effected by the guest or Customer and expenses incurred by the Boutique Hotel vis-à-vis third parties
3. The agreed prices shall include the statutory rate of VAT and all local taxes
4. The Boutique Hotel’s invoices are payable in full immediately upon receipt.

Force majeure

We will accept no liability and will not pay any compensation where the performance of our obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond our reasonable control including, but not limited to, flood, earthquake, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water or other utility service.

Boutique Hotel Stay, Room Availability, Delivery and Return

1. Palazzo Bifora offers WIFI access that allow you to connect to the internet. You undertake to ensure that computing resources made available by us are not used for any illegal purposes or in any way for reproduction, representation, provision or communication to the public work or object protected by copyright or related right such as texts, images photographs (and so on) without the authorization of the copyright holder when this authorization is required. You agree to be bound by all the terms and conditions of our wifi provider.
2. Unless otherwise agreed in writing on the booking confirmation, You are entitled to check in at any time from 3:00 p.m on the agreed arrival date. The Customer does not have the right to earlier availability.
3. On the agreed date of departure, You shall kindly vacate your room(s) and make them available to the hotel no later than 11:00 am unless otherwise agreed in writing. After that time, on the grounds of the delayed vacating of the room for use exceeding the contractual time, the hotel may charge 50 percent (50%) of the full accommodation rate for the additional use of the room until 6:00 p.m. (after 6:00 p.m full charge applies).

4. Palazzo Bifora provides a safety deposit box in the rooms. The Boutique Hotel is not responsible for any valuables and money left unlocked and outside the individual safe, including those in the guest’s rooms and public areas.
5. Wake-up calls can be set by the guest using the guest room phone following the easy instructions audibly and pressing the wake-up button and they are also carried out by the hotel with the greatest possible diligence. Messages, mail and merchandise deliveries for guests are handled with care. The hotel assumes no liability in this regards but will make its best effort to deliver, hold, and for a fee forward such items (on request).
6. The Boutique hotel does not have a car park, and does not provide parking spaces. Guests arriving with their own or rented cars may use the public parking spaces in the area.
7. Palazzo Bifora is a NO SMOKING property.
8. Palazzo Bifora is equipped with CCTV system which covers the public areas.

Jurisdiction and dispute resolution

These terms and conditions form a binding contract between OJALA LTD. and the Customer and shall be governed, interpreted and construed in accordance with the laws of Malta. All disputes arising from or in connection with the services offered by the Boutique Hotel shall enjoy the sole and exclusive jurisdiction of the courts of Malta.
